One conviction upheld, one thrown out
Floydzell Johnson of Tifton was charged with murder and sentenced to life for taking the life of 26 year old J.B. Melton in 2009.
The incident happened on Short Street and 2nd Avenue in July of 2009; when officers arrived at the scene Melton was running towards them and had been shot. Melton died just before EMS crews arrived at the scene.
Johnson was found guilty of murder and sentenced to life in prison.
FOX 31 received a press release Monday saying although his murder conviction and sentence have been upheld by the courts, his conviction and sentence for possession of a firearm by a convicted felon were thrown out because the charge should have been merged with his murder count.
