An restraining order to stop construction plans of the Lee County Medical Center has been shot down.

Lee County officials say that Dougherty County were denied the restraining order during a Tuesday afternoon hearing in Fulton Superior Court.

“We felt like all along this is a senseless opportunity to attempt to delay us," Lee County Commissioner Rick Muggridge said. "The judge saw through that and denied it rather quickly."

However, Dougherty County still has a pending lawsuit against the Georgia Department of Community Health over the Certificate of Need that was granted for the project.

FOX 31 has reached out to Dougherty County representatives, but they say they have no comment at this time.

Muggridge says they are starting the construction process by having a contractor work on storm drainage. Muggridge says he believes by the time they are ready to start physical work, the pending lawsuit will be dropped.

Muggridge predicts a summer start date.
